Radio Client Terms & Conditions
Effective March 5th, 2022
Fees & Commissions:
Monthly fees are currently set at $30.
Members (hereinafter referred to as “clients”) set the prices for all products sold on Ocean Opus’ website. Revenue payouts are set for distribution daily.
* Ocean Opus charges a commission of 15% from all digital download sales, and from merchandise sales, additional fees are added to cover processing fees. The bank sets processing fees, usually around 3% of sales + $0.30. * Bank processing fees may fluctuate.
Membership Cancelation:
Clients may cancel their memberships at any time; however, their account will remain active for the duration of their billing cycle. Ocean Opus does not issue partial refunds. Upon cancellation, the Artist’s intellectual property will be removed from Ocean Opus Radio and website within 3 days after their final day of membership.
Ocean Opus reserves the right to continue to use any content created by Ocean Opus for its clients (such as Written Editorials & Podcasts ); it is understood that the aforementioned content is the intellectual property of Ocean Opus.
Content and License:
We strongly believe that a musician’s intellectual property must remain their own and that Ocean Opus may use no content for advertising or streaming without prior consent by the musician. Ocean Opus will not continue to air our clients’ work or create any new social media add campaigns with their submitted content once their membership has been canceled; if, however, an Artists’ content is active within an existing ad campaign, it is understood that Ocean Opus reserves the right to continue to use the content until the ad campaign has expired.
Client’s Intellectual Property:
It is understood that the client is the sole and rightful owner (or duly authorized representative of the said owner) of all rights associated with any and all content uploaded to Ocean Opus’ website or submitted to Ocean Opus Radio (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text, and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed on the website.
Ocean Opus is not responsible for any stolen content and reserves the right to terminate a client’s membership if illegal content is discovered in their Electronic Press Kit, Music Store, or music submitted to Ocean Opus’ Radio Station and streaming services and hereby promises to indemnify and hold harmless Ocean Opus’ Station, business, owners & employees for any claims or suits arising out of any licensing infraction.
Right to Change and Modify Terms & Conditions:
We reserve the right to modify these terms occasionally at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify all members that material changes have been made. All members will receive 14 days notice of any changes to fees, monthly memberships, and policies by email. It is understood that the client agrees to the adjusted or added fees by not canceling their membership. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, the client must cancel their membership.
